Hey, so today we’re going to talk about “does visa or immigration status affect your chances of getting an ITIN”?

So today we’re going to be talking about does visa or immigration status affecting your chances of getting an ITIN, and let me just say that the answer is no, it doesn’t affect your chance of getting an ITIN but it definitely alters the route we take or dictate the type of case you’re going to have in order for us to be able to get you an ITIN.

So I’m going to recap the answer real quick.

Does your visa or immigration status prevent you from being able to get an ITIN?

No, it just dictates or alters the path we’re going to take with your documentation or the type of case you have to help you get your ITIN.

So with that being said, I also want to state that having an ITIN does not change your work status or your immigration status.

So I just wanted to throw that in there as well too because that’s a common misconception people have.

How Does Your Visa Affect Your Chances to Get an ITIN?

Now, let me give you guys an example of how this works.

For example, a visa, how does your type of visa that you have to affect your ITIN case?

The most common one I would say is let’s say you’re on a B- 1/B-2 visa and it’s a tourist visa, it’s a visitor’s visa. If you’re on a B-1/B-2 and … Under the rules of the B- 1/B-2 you’re not supposed to be in the states for more than 60 days, sometimes it’s different, but this is a general rule of thumb, and on the rules of that visa, you’re supposed to be a non-resident alien for tax purposes.

So it’s not going to prevent you from getting an ITIN because even as a non-resident alien you can still apply for an ITIN.

Like for example, one of the options on the ITIN application is non-resident alien filing a U.S. federal tax return, so it just means the type of visa you have is just dictating the type of path we’re going to take for your case.

Let’s say you’re doing a tax return, instead of checking off box C as U.S. resident alien for tax purposes, you’re going to be checking off box B which is non-resident alien filing a U.S. federal tax return.

So it’s just different. It doesn’t prevent you, it just changes some things we check off or paths we take for your application.

 

Does Your Immigration Status Tell You Can’t Apply for an ITIN?

Let’s give an example of immigration status.

You know, I specialize in working with non-U.S. citizens and I deal with undocumented or illegal immigrants all the time every day and I’ve helped hundreds and hundreds of them get their ITINs.

It doesn’t mean you can’t apply for one, just because you don’t have status in this country doesn’t mean you can’t apply for your ITIN and we’ve been able to help hundreds of them get their ITINs in the past and we’d love to help you get yours as well too.

Just because you don’t have status doesn’t mean you’re not able to get an ITIN. It just obviously … That dictates what path we’re going to take to get the right documentation we need to apply for your ITIN.

This is a very common misconception people have.

Now there are certain visas where it changes your case more than others. A B-1/B-2 doesn’t change the case as much as let’s say for example an A visa does or something like that, so it just depends on that too.

Applying an ITIN for Dependent or Spouse of a Non-US resident

Another common case about the visas I want to add is like for example if someone’s here on an F-1 visa and they also have their spouse or dependent with them who’s on an F-2 visa, instead of checking off the box for U.S. resident alien for tax purposes or the box for non resident alien filing a tax return, that one would be different.

If they’re trying to get their ITIN for their spouse or dependent, now you’re checking off like a whole complete different box.

You’re checking off the box … The box that says dependent or spouse of a nonresident alien holding a U.S. visa.

 

What To Do Next

So there are so many different scenarios. So it doesn’t affect your chance to get an ITIN but it just changes the path we take or the boxes we check or the documentation we need to get.
