Can I Get a Job If I Have an ITIN?

Okay, so we’re going to be talking about one of the most popular questions that we get about ITINs daily, even hundreds of times a day.

That is, “can you use an ITIN to get a job?” And the answer is, technically yes.

Now I say technically with emphasis and I’ll tell you why right now. I want to preface my response with the fact that getting an ITIN does not change your immigration status and it does not grant you work status. That’s the first thing I want to just throw out there that a lot of people don’t know or don’t realize, especially non-US citizens who are inquiring about the service.

Getting an ITIN does not change your immigration status and it does not grant you work status. It is simply an ID for tax reporting purposes.

Let’s say you’re physically present in the United States and you go to an employer and you are looking to get a job from that employer. If the employer, regardless of their liability or at their discretion, if the employer states to you, “You know, I will hire you and I can hire you if you can provide me an ITIN,” then technically speaking, you can gain employment by having an ITIN.

Now, I’m not talking about status, I’m not talking about if it’s legally right, this and that.

I’m talking about can you technically gain employment by providing an ITIN to an employer that’s requesting it to get a job?

Yes, you could. Now obviously, there are asterisks on all this.

We’re not discussing what liability or the choice of the employer at their discretion to hire you using an ITIN and not looking at your work status. That is at their discretion and vice versa for yourself as well too. So, there are layers to this question.

Technically you could use an ITIN to gain employment. You could get a job if an employer is telling you, “I’ll hire you if you just give me an ITIN regardless of whatever your status is.” Okay, that’s true.

You could technically get employment, but I always say this with an asterisk and I say status is also important here.

If you don’t have work status, technically speaking, that should be the case. So yeah and it goes both ways.

I do get this question a lot and I try my best to answer it as clear as I can, but also kind of be technical too and kind of just explain both sides of it, both for the employee standpoint and then also from the employer standpoint.
